Chapter 11 - THE MONEY HE DIDN’T HAVE

Derek’s business books were worse than expected.
Not outright giant embezzlement.
Messier.
He used deposits from new jobs to finish old jobs.
Common cash-flow problem.
Then he started using new deposits to pay personal debt.
Then taxes.
Then one truck.
Then another project failed.
The hole widened.
Some clients still got completed work.
Others delayed.
One threatened fraud complaint.
Derek told his accountant he had “family collateral coming.”
My condo.
His father’s future repayment.
My salary.
Everything future.
Everything somebody else’s.
Then one lender email:
Need proof of ownership interest in inherited condo.
Derek:
Spouse will transfer this week.
This week.
The garden week.
Then another:
Need wife direct signature.
Derek:
She is medically stressed. POA pending.
Medical story tied directly to finance.
That was huge.
The psychiatric narrative was not only custody strategy.
It could support a power-of-attorney pathway.
Then the draft POA.
Signature forged.
Forensics matched.
Now prosecutors had clearer financial motive.
Then one more document.
A deed transfer form listed consideration:
$10.
Standard nominal consideration possible.
But attached internal note:
Property to be refinanced immediately.
So if I signed the condo over, the plan was not to simplify assets.
It was to borrow against it fast.
Then Maya asked:
“Did Derek ever tell you the business was failing?”
“No.”
“He told me it was expanding.”
He had hired two new workers weeks before.
Why?
Appearance.
Maybe contracts.
Maybe denial.
Then his accountant testified later that he repeatedly warned Derek:
Do not use spouse property without independent consent.
Derek replied:
“It’s marriage. It’s all one pot.”
There.
Belief.
Again.
Then Claire found something else.
A package delivered to her house by mistake.
Same street numbers reversed.
Addressed to Derek.
From a private investigator.
She gave it unopened to police.
Warrant later obtained equivalent records directly.
Derek had hired an investigator to document my movements.
Photos of me at Claire’s.
My sister’s.
Prenatal yoga.
The condo.
Notes:
Potential relocation behavior.
He was tracking exit planning.
Then one photo showed me entering a legal-aid office.
Date:
Two weeks before the garden.
I had gone there for a free seminar.
He knew.
That probably accelerated everything.
Control often becomes most dangerous when it senses it is losing control.
The private investigator later testified he thought he was doing ordinary marital fact gathering.
