Chapter 14 - THE MEDIATION

Mediation lasted eleven hours. No dramatic courtroom. Conference rooms. Spreadsheets. Coffee. Lawyers walking back and forth. Diane in one room. Me, Kyle, Rose, Emily in another. Ethan beside me. Then terms. Carter Community Events building sold. Proceeds first to valid reserve obligations and secured debt. Rose repaid. Other contributors repaid proportionally. My account loss restored as far as traceable. Kyle’s share adjusted for benefits he had already received. Emily paid the $50,000 Dad documented. Nora’s 529 transferred to independent trustee. Diane retained a modest amount representing verified personal contributions and lawful earnings. No one took everything from her. Good. Restitution, not revenge. Then criminal case separate. Mediation could not erase assault. Could influence restitution. Then Diane asked to read statement. My lawyer said no direct emotional pressure. But written through mediator. I agreed. Statement: I spent thirty years believing money was what kept this family together.

Then: Thomas made money and avoided conflict. I moved money and solved crises. Everyone thanked me until they learned where it came from. Then: That does not make what I did right. Good. Then: I thought Lena was strong enough to lose things. My chest tightened. There. Role. Then: I thought Kyle was weak enough to deserve more. Kyle started crying. Then: I damaged both of them by deciding who needed what instead of asking. There. Then: When Nora’s diagnosis came, I panicked. I thought if I controlled the money, I could control what happened to her. That was the core. Then: When the ledger fell out, I saw my whole life opening in front of everyone and I hit my daughter. No excuse. Then: I am ashamed. I did not forgive. But I believed she finally understood the sentence. Then mediation nearly collapsed over the community building sale. Diane wanted to keep it. Why? “It’s all I built.” But built with mixed money. Then Rose said through mediator:

Tell Diane Thomas wanted the building sold if reserve could not be restored. Document supported. Diane finally agreed. Then one surprise. A nonprofit offered to buy building and convert it into family support center for parents of medically fragile children. Mara knew them. The same room where Diane hit me could become a place for families needing respite, counseling, and financial navigation. Too symbolic? Maybe. But practical. Offer fair market. We accepted subject board financing. Then I asked: “Can the baby-shower room be renamed?” Everyone stared. I laughed. “Not after Nora.” No memorial. Just no Carter name. Good. Then Diane’s criminal plea. She agreed to felony financial exploitation/forgery-related count? Family trust not elder. Let's say felony fraud and forgery, plus misdemeanor assault/reckless endangerment. Sentence likely included county custody and home confinement due age, restitution, no contact conditions. Then prosecutor asked me victim-impact preferences.

I said: “I care more that she cannot control anyone’s finances than how many months she sits in a cell.” That shaped probation terms. No fiduciary roles. No account access for family. No unauthorized medical records. No contact with Nora without my written consent. Then Diane agreed. Then before signing final mediation, she asked one question: “Will Lena ever let me see the baby?” Mediator brought it. I answered: “I don’t know.” Not no. Not yes. Truth. Then Diane signed anyway. That mattered. For the first time, she accepted a consequence without making access the price. Then the building buyer called. Financing approved. Closing scheduled. Then title company found a lien. $160,000. Filed two years earlier. Creditor: KYLE CARTER CONSTRUCTION. Kyle stared. His company had a lien on Mom’s building. He never filed it. Signature on lien authorization: Kyle Carter. Not his. Again. And if the lien was fraudulent, someone had created a final mechanism to send sale proceeds straight to my brother.

The question was whether Diane did it to protect Kyle—or to make him look like the thief if everything collapsed.
