Chapter 13 - The Forged Deed Did Not Vanish Just Because Everyone Knew It Was Fake
Our civil title case took:
months.
Not days.
The court needed:
certified death certificate,
prior recorded deed,
survivorship documentation,
handwriting evidence,
notary testimony,
recording documents,
responses from Mark and Emily as named grantees,
evidence about my alleged signature.
Emily disclaimed any claim based on the forged conveyance.
That simplified things.
Mark, through counsel, eventually did too.
The court entered an order clearing the fraudulent deed from the chain of title.
That part was straightforward once the evidence aligned.
But other issues remained.
Could Mark or Ron claim reimbursement for improvements?
Possibly for certain documented contributions under equitable theories?
Maybe.
We negotiated rather than spending three years litigating every:
dock board,
retaining-wall block,
invoice.
I paid a documented net amount representing several improvements I had benefited from and never fully reimbursed.
Not because:
they owned the cabin.
Because:
I had accepted value.
Accuracy mattered.
Separately, criminal investigators handled:
forgery,
false instrument,
fraudulent recording
under applicable state law.
I did not control charging decisions.
Good.
Ron repeatedly complained:
“This is a family matter.”
Deputy Mills later told me:
“Family doesn’t make documents less real.”
Exactly.
Then there was:
my punch.
The district attorney could have treated it as:
battery.
Ron’s shove came first.
But because I stepped back in and struck him after the immediate threat passed, my self-defense argument was not clean.
I accepted responsibility.
The matter resolved with:
a low-level disposition,
no jail,
and no pretending I was entitled to hit him because he was awful.
Emily asked:
“Do you regret it?”
“Yes.”
“Really?”
“Completely.”
Then:
“Still felt good for about four seconds.”
She laughed.
“Dad.”
“I said I regret it.”
