Chapter 7 - The Trust Judith Pretended Didn’t Exist
The legal packet was the real center of everything.
It contained a formally executed amendment to the Carter Family Trust.
Signed by Dad.
Witnessed.
Notarized.
Reviewed by two independent attorneys.
Accompanied by a physician’s capacity statement because Dad’s health was already being questioned.
There was nothing improvised about it.
Under the older trust structure, Mom held significant authority after Dad’s death.
That arrangement made sense twenty years earlier when the family businesses were smaller and I was younger.
Dad had never fully updated it.
Until his final year.
The new amendment changed several critical things.
Mom retained lifetime income from designated assets.
She kept the mountain residence in Colorado Springs.
She kept substantial personal investments.
She was not being disinherited.
But her authority over Carter Alpine Hospitality ended.
I would become managing family trustee for business interests.
A professional fiduciary would serve beside me on major transactions.
Ella’s trust would be funded immediately and independently.
Rachel would become successor protector of that trust if anything happened to me.
And Mom would have no power to delay, borrow against, redirect, or restructure Ella’s assets.
That last provision mattered.
During the eighteen months after Dad died, Mom had repeatedly delayed funding Ella’s trust.
She said market conditions were poor.
She said liquidity was complicated.
She said Dad never intended the trust to activate immediately.
All lies.
The amendment clearly required it.
There was also a clause restricting the sale of two flagship resort properties without independent approval.
Mom had already begun preliminary negotiations concerning one of them.
Now we understood the motive.
Dad’s valid trust stripped Mom of the exact authority she had been exercising.
If the amendment surfaced, nearly everything she had done after his death would be reviewed.
