Chapter 7 - THE TRIAL BY WATER

The courtroom was crowded on the first day of trial.

Richard wore a charcoal suit.

Vanessa wore white.

She looked less like a defendant than a woman arriving at a charity luncheon.

Olivia sat behind the prosecutor with Emily’s small bracelet wrapped around her fingers.

Emily was not present.

Olivia refused to make her daughter see them.

The prosecution opened with the pool footage.

No dramatic music.

No narration.

Only a child falling.

A mother running.

A grandfather restraining her.

A woman watching.

Then the sentence.

Leave her.

The jury heard it twice.

Grace testified.

She described the conversation before the fall.

The defense attacked her memory.

So the prosecution played her recording.

Push harder.

Fear is the point.

Now make her hit you.

Vanessa looked at Richard.

Richard did not look back.

Officer Reyes testified next.

He described the scene.

Emily coughing.

Olivia holding her.

Vanessa laughing.

Richard immediately calling Olivia unstable.

The defense asked whether Olivia struck Vanessa.

“Yes.”

“Was Vanessa injured?”

“She had redness on her face and fell into a chair.”

“So Olivia committed violence in front of her child.”

Reyes remained calm.

“I observed a mother responding after her child was pushed into deep water.”

“That was not my question.”

“It is the complete answer.”

The courtroom shifted.

Patricia testified under the plea agreement.

She admitted the forged forms.

The custody plan.

The breakfast conversation.

The insurance policy.

Richard stared at her with contempt.

His attorney asked whether Patricia was blaming her husband to reduce her own sentence.

“Yes,” she said.

The honesty surprised everyone.

“I want less prison time. I also lied for him for forty-three years. Both things are true.”

The prosecutor called Olivia last.

She described the moment Emily disappeared.

“What did Richard say?”

“Leave her.”

“What did you understand those words to mean?”

“That my daughter’s life mattered less to him than whatever lesson he thought he was teaching me.”

The defense attorney approached.

“You slapped Vanessa.”

“Yes.”

“You did so in front of dozens of guests.”

“Yes.”

“You lost control.”

“Yes.”

“So Richard’s concerns about your temper were valid.”

Olivia looked at the jury.

“I lost control for one second after she pushed my five-year-old daughter into deep water and called it a joke. Richard planned for that reaction because he thought one angry second could erase everything he did before it.”

The attorney changed direction.

“You knew Emily could not swim well.”

“Yes.”

“You allowed her near the deep end.”

“She was beside me.”

“You were distracted.”

“For seconds.”

“So this incident could have been prevented by better supervision.”

Olivia’s voice remained steady.

“It could have been prevented by Vanessa not pushing her and Richard not holding me back.”

The attorney played the clip of Olivia’s slap repeatedly.

The prosecution then played the four seconds before it.

Vanessa laughing.

Richard saying, “Now make her hit you.”
