Chapter 8 - RICHARD’S TESTIMONY

Richard made the mistake of testifying.

He believed confidence could replace evidence.

It had worked his entire life.

He told the jury he loved Emily.

He described himself as a strict but devoted grandfather.

He claimed Vanessa accidentally bumped her.

He claimed Olivia panicked.

He claimed his words had been misunderstood.

The prosecutor asked, “Why did you say, ‘Leave her’?”

“I meant leave the rescue to trained staff.”

“No trained staff had reached the pool.”

“I expected them to.”

“Why did you physically restrain Olivia?”

“To prevent chaos.”

“Why did you tell Vanessa, ‘Now make her hit you’?”

“I was upset.”

The prosecutor displayed the custody petition dated before the incident.

“Why had you already prepared to call Olivia dangerous?”

Richard shifted.

“Family concerns existed.”

“Why was there a two-million-dollar policy on Emily?”

“Estate planning.”

“Why was Olivia’s signature forged?”

“I trusted professionals to handle paperwork.”

“Why did you tell Vanessa to push harder?”

Richard looked at the jury.

“I meant emotionally.”

The prosecutor let the silence expose the lie.

Then she presented the garage incident.

Phone records showed Richard’s private investigator entered Olivia’s property and left the swimsuit.

The investigator testified in exchange for immunity.

Richard hired him to frighten Olivia and film the aftermath.

“What did Mr. Carter tell you?” the prosecutor asked.

“He said fear makes unstable people reveal themselves.”

Olivia closed her eyes.

There it was again.

Fear was not something Richard regretted causing.

It was a tool.

Vanessa testified against him after the private investigator’s statement surfaced.

She claimed Richard controlled the entire plan.

She admitted pushing Emily but insisted she believed the child would grab the rail.

The prosecutor asked, “Why did you count while Emily was underwater?”

Vanessa began crying.

“I panicked.”

“You counted calmly.”

“I did not know what to do.”

“You knew enough to wait.”

Vanessa looked toward Olivia.

“I am sorry.”

Olivia did not react.

An apology offered after evidence was not the same as remorse.

The jury deliberated overnight.

Olivia returned to the hotel with Emily.

Her daughter had drawn another pool.

This time, the water was blue.

Olivia asked, “Who is this?”

Emily pointed to a woman standing beside the edge.

“You.”

“And who is in the water?”

“No one.”

Olivia looked closer.

Emily had drawn a fence around the pool.

A locked gate.

A red rescue float.

Safety.

Not revenge.

Not Richard in prison.

Not Vanessa crying.
