Chapter 12 - Daniel’s custody did not disappear because he made a terrible decision
Claire’s attorney could have used the terminal incident aggressively.
Instead, both sides moved carefully.
Daniel had participated in an attempted international departure during an active custody dispute.
That was serious.
He had also believed false information supplied by Victoria.
He had not placed Ava in the suitcase.
He had not known she was inside it.
When he arrived, he believed Robert was preventing him from taking custody of his own daughter.
That explained his confrontation.
It did not excuse every choice.
The family court examined the situation closely.
Daniel temporarily agreed that international travel would require court approval.
He reduced work travel.
He began direct co-parenting-style communication with Claire regarding extended-family contact even though Claire was not Ava’s parent.
He attended parenting therapy focused on grief transitions.
The court did not automatically remove Ava from him.
That mattered.
Family law was not a morality contest where one catastrophic day erased an otherwise established parent-child relationship.
Daniel had cared for Ava.
Loved her.
Supported her.
The question was whether he could become safer and more independent from Victoria.
He did.
Slowly.
Claire withdrew the most restrictive parts of her petition once Daniel created a stable plan.
She retained regular contact with Ava.
Robert did too.
Victoria did not.
A protective order barred her from approaching Ava while criminal and civil matters were addressed.
The court treated her role differently because she was not Ava’s parent and had participated directly in concealing the child.
The blue passport returned to Rebecca Sloan’s custody during the litigation.
Not because passports belonged to lawyers.
Because all sides agreed the document should stay somewhere neutral until travel rules were resolved.
For the first time in months, nobody in the Bennett family had unilateral physical control of it.
