Chapter 11 - Ethan Went Back To The Road

Ethan avoided Blackwater Ridge for thirteen years.

After Marianne died, he took a different route whenever he drove north.

Then one November morning, he went back.

Emily went with him.

The curve looked insultingly ordinary.

A guardrail.

Pines.

A shallow drop beyond the shoulder.

No permanent marker told strangers their mother had died there.

Ethan parked at a safe pullout several hundred yards away.

For a while they said nothing.

Then Emily asked:

“Do you think Mom would still be alive if Laura hadn’t called?”

Ethan stared toward the road.

It was the question they both feared.

“I don’t know.”

Emily’s eyes filled.

“She wouldn’t have been on this road.”

“No.”

“That means Laura caused it.”

Ethan shook his head carefully.

“She caused Mom to change where she went that night. She caused the confrontation. She lied afterward.”

Emily looked angry.

“But?”

“But the crash was still a crash. We don’t know what would’ve happened if Mom went straight home.”

She wiped her face.

“I hate that answer.”

“So do I.”

That became one of the central truths of the case.

Moral causation and legal causation are not always the same.

Laura’s deception placed Marianne on that route.

But the evidence did not prove Laura intended Marianne to crash or could reasonably predict the exact accident.

Emily wanted a clean line from Laura’s lie to Marianne’s death.

Reality gave her something messier.

Laura had not murdered her mother.

She had manipulated her, frightened her, lured her into a confrontation, and then spent thirteen years hiding that fact.

That was still enormous.

May you like

It just was not homicide.
